The Verdict 

On March 4, 2024, a Miami federal judge ruled in favour of Earth, Wind & Fire LLC, deciding the tribute band's “deceptive and misleading” marketing was IP infringement. Judge Federico A. Moreno ruled that the advertisement and marketing were still deceptive and misleading regarding whether the main members of the band would be performing. The trial was scheduled for May 2024 to determine the damages. 

Settlement and Trial Outcome 

In May 2024, just before the trial to determine damages was set to commence, Earth, Wind & Fire LLC and the defendants reached a settlement. The terms included a substantial monetary compensation to Earth, Wind & Fire LLC and an agreement by the tribute band to cease using the name "Earth, Wind & Fire Legacy Reunion" and any logos or marks associated with the original band. The settlement also required the tribute band to clearly differentiate itself in future promotions to avoid any potential consumer confusion.
